These Terms and Conditions govern your use of the website www.thenerdyden.com (the "Site") and all services and products provided by The Nerdy Den ("we," "us," or "our").

By accessing the Site, or by placing an order for a Custom PC Build or Repair Service, you agree to be bound by these Terms. We reserve the right to refuse service to anyone.

1. Scope of Services and Goods

1.1 Custom PC Building Services

We agree to custom-build a computer system ("Custom PC") based on the specific components, specifications, and labor described in the finalized and signed Custom Build Quote/Invoice (the "Agreement"). Currently, the PC portion of our business, is only Serving Delta County, CO.

Final Specifications: The Custom PC is built based solely on the written specifications detailed in the final Agreement. Any verbal promises are superseded by the 'Written Agreement'.
Component Availability: We reserve the right to substitute components of equal or greater value and performance if the initially specified part becomes unavailable or backordered. We will notify the Client of any material substitutions but will always keep quality of component a priority.
Ownership of Parts: All components purchased for the Custom PC remain our property until full payment is received.

1.2 Computer Hardware Upgrades

We agree to upgrade specific computer hardware ("Upgrades") based on the specific components, specifications, and labor described in the finalized and signed Custom Build Quote/Invoice (the "Agreement"). Currently, the PC portion of our business, is only Serving Delta County, CO.

Final Specifications: The upgrades are installed based solely on the written specifications detailed in the final Agreement. Any verbal promises are superseded by the 'Written Agreement'.
Component Availability: We reserve the right to substitute components of equal or greater value and performance if the initially specified part becomes unavailable or backordered. We will notify the Client of any material substitutions but will always keep quality of component a priority.
Ownership of Parts: All components purchased for the Custom PC remain our property until full payment is received.

1.3 Computer Repair and Diagnostic Services

We agree to perform the repair, diagnostic, or maintenance services ("Repair Services") on the client-owned device ("Client Equipment") as described in the signed Repair Diagnostic Form or equivalent work order. Currently, the PC portion of our business, is only Serving Delta County, CO.

Free Diagnostic Window: A reasonable attempt will be made by 'The Nerdy Den' to attempt to fix the computer. If the fix occurs in the first 15 minutes, It will be noted as so and there will be no charge.
Diagnostic Fee: A non-refundable diagnostic fee of $75 will be applied, payable upfront, which will be credited toward the total cost of the approved repair. If the computer is deemed unrepairable, the $75 fee will be the only charge.
Repair Authorization: Repairs will only proceed upon Client's written or electronic authorization of the final quoted cost. If the Client declines the repair, only the diagnostic fee will be charged.
Unclaimed Equipment: Client Equipment left with us for more than 60 days after the completion of the service or after the client declines the repair quote will be considered abandoned and may be subject to sale or disposal to cover repair and storage fees, as permitted by applicable law.

1.4 Mystery Box - The Products and Service Options

The Nerdy Den offers two primary mystery book box products: the Classic Mystery Box and the Premium Mystery Box. These products are available for both One-Time Purchase and as a Recurring Subscription.

Classic Mystery Box: The standard price for a one-time purchase is $35.00 USD.
Premium Mystery Box: The standard price for a one-time purchase is $50.00 USD.

A. One-Time Purchases

Customers may purchase either the Classic or Premium Mystery Box as a single, one-off order. The payment is charged immediately at checkout.

B. Recurring Subscriptions and Discount

Customers who choose to enroll in a recurring subscription plan receive an automatic 10% discount off the standard price for the duration of their continuous subscription.

The subscription price for the Classic Mystery Box is $31.50 USD per box.
The subscription price for the Premium Mystery Box is $45.00 USD per box.

All prices listed are exclusive of shipping charges and any applicable sales tax, which will be calculated and added during the checkout process.

1.3.1 Pricing, Payments, and Billing

Billing Schedule for Subscriptions

All recurring subscriptions (Classic and Premium) are billed on the day of initial purchase every calendar month. By signing up for a subscription, you authorize The Nerdy Den to automatically charge the discounted rate ($31.50 or $45.00) to your designated payment method until you cancel. The initial subscription charge occurs immediately upon sign-up.

2. Payment Terms

2.1 Pricing and Quotes

All prices and quotes are in USD and are subject to change until the Custom Build Quote/Invoice is finalized and signed. Taxes are not applied to the listed amounts.

2.2 Payment for Custom PCs

A 100% non-refundable deposit of the total Custom PC price (including all parts and labor) is required before ordering any components. Any unpaid remaining balance is due in full upon completion of the build and prior to shipment or handover.

2.3 Payment for Repair Services

Payment for all Repair Services is due in full upon completion of the repair and prior to the return of the Client Equipment.

2.4 Methods of Payment

We accept Visa, Mastercard, American Express(Amex), ChinaUnionPay, JCB, Diners, Discover, Electron, Maestro, Apple Pay, Google Pay, PayPal, Afterpay, Affirm, and Klarna.

3. Warranties, Returns, and Liabilities

3.1 Custom PC Warranty

Labor/Workmanship: We provide a 2 year warranty on the labor and workmanship of the Custom PC build, effective from the date of handover/delivery. This warranty covers the physical assembly and clean operating state of the system. This does not cover computer failing from malicious software, viruses, or intentionally modifying of hardware outside of what I delivered to you.
Parts Warranty: All new components (CPU, GPU, Motherboard, etc.) are covered by the original manufacturer's warranty. We will assist the Client in coordinating RMA (Return Merchandise Authorization) with the component manufacturers, but we do not guarantee the manufacturer's warranty terms or replacement timeline.

3.2 Repair Service Guarantee

We guarantee our Repair Services will be performed in a professional and workmanlike manner. We offer a 30-day warranty on the specific labor performed. This warranty does not cover issues unrelated to the original repair.

3.3 Limitations of Liability (CRITICAL CLAUSE)

The Client acknowledges and agrees to the following limitations:

Data Loss: We are NOT responsible for any data loss (including programs, data, files, or settings) that may occur during Custom PC building, diagnostics, or Repair Services. The Client is solely responsible for backing up all data prior to delivering any equipment or confirming a build order.
Existing Defects: We are not responsible for pre-existing defects, compatibility issues, or any damage to Client Equipment that occurs outside the scope of the Repair Services.
Maximum Liability: In the event of damage to Client Equipment while in our possession, our liability shall be strictly limited to the cost of repair or replacement of the damaged component(s), or the current market value of the Client Equipment, whichever is less. In no event shall our liability exceed the total fee paid by the client for the specific service in question.

3.4.1 Returns/Cancellations (Custom PCs)

Since each PC is custom-built, orders cannot be canceled once the initial deposit is paid and parts have been ordered. The initial deposit is non-refundable. Consideration of a 1:1 purchase on case by case basis. (Example you pay $1k on custom built computer and you determine that you do not want it, I can make the decision to buy the computer from you at the same cost you paid for it. It is at my discretion if I decide to do this.)

3.4.1 Returns/Cancellations (Mystery Book Boxes)

How to Cancel: Customers may cancel their subscription through their online account portal or by contacting The Nerdy Den.
Cancellation Deadline (Cut-off Date): To successfully cancel a subscription and avoid being charged on the initial purchase day of the following month, the cancellation request must be received before 11:59 PM MST 5 days prior to the next billing date.
- For example: To prevent being charged on December 1st, cancellation must be completed by November 25th.
Effect of Late Cancellation: If a subscription is canceled on or after the 26th day of the month, the Customer will still receive and be charged for the upcoming box (billed on the 1st), and the cancellation will then take effect for the cycle following that one. The selected subscription box will still be sent.
No Refunds for Partial Periods: The Nerdy Den does not provide refunds or credits for any partial subscription period.

4. Client Responsibilities

Access: For Repair Services, the Client must provide us with the necessary access, passwords, and administrative rights required to perform the requested service.
Legal Software: The Client guarantees that all software, operating systems, and licenses provided to us for installation are legally acquired and properly licensed.
Equipment Condition: The Client guarantees that any Client Equipment is free of illegal material.

5. Intellectual Property and Content

All content, logos, text, graphics, and designs on the Site are our property and are protected by intellectual property laws. You may not use any content from the Site without our express written permission.

6. General Website Terms

Prohibited Uses: You may not use the Site for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, or to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances.
Right to Refuse Service: We reserve the right to refuse service to anyone for any reason at any time.
Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Colorado and the country of The United States.

7. Changes to the Terms and Contact Information

We reserve the right to update or change these Terms and Conditions at any time. The "Last Updated" date at the top of this page indicates when the latest revisions were made.
